Multiple Code Violations Threaten Navarre Beach Lease

A Navarre Beach leaseholder is facing possible termination of its lease by Santa Rosa County after multiple code violations have not been remedied – despite citations and fines being issued.

(The) Palms of Navarre, LLC, which is based in Pell City, Alabama, is owned by Sylvia Martin, per State of Florida documents. The company leases property located at 8649 Gulf Boulevard, which is being subleased to Andy D’s Restaurant.

An August 9 letter from Santa Rosa County Attorney Thomas V. Dannheisser to the company stated:

“Your sub-lessee, Andy D’s Restaurant, is in violation of various County Land use regulations and has failed to remedy the violations. This failure to remedy violates Paragraph 7 of your lease (agreement). Please have your sub-lessee remedy the violations within 10 days of the date of this letter so the County does not need to take action on your lease.”

Paragraph 7 of the lease states that the lessee agrees to comply with all laws, ordinances, rules and regulations by jurisdictional governmental bodies.

The issues arose after a code compliance case was opened June 13 for violation of county ordinances. Officer Nathan Bell was assigned to the case.

Per Santa Rosa County officials, Andrew DeMartin of Andy D’s was informed July 11 that feather flags needed to be removed by July 14. However, a July 14 compliance visit revealed air-activated and wind-driven signs still present, so a $203 citation was issued.

An August 11 code compliance check revealed multiple code violations, including: itinerant vendors which did not have permits and were not approved on the site plan and signage violations on the property and within the county’s right of way. Subsequently, a $703 fine was assessed.

Palms of Navarre, LLC has not yet responded to a request for comment.
